derbi predator lc 2000 is draining my battery!

hi please some1 help, my kick start dosent work only my electric does. when the bike is cold it just turns over abot 7 - 8 times slowley dieing then just dies. but when the bike is room temp it starts perfectly, i did change the battery to a new 1 and it did just the same. i think its the starter but i could be rong and dont really want to buy something i might not need.
